Simple guidelines to follow when involved in any type of motor vehicle accident

You were suddenly struck by a car – blindsided almost.  Now What?

Most motor vehicle driver’s have no idea how to handle the immediate after effects of an auto accident.. until it happens to them.

Below you will find some helpful tips from Chicago Motor Vehicle Accident Lawyers at The Horwitz Law Group..

FOLLOW THESE GUIDELINES STRICTLY TO PROTECT YOUR RIGHTS:

Stop Your Car

** Leave your vehicle as close as possible to the place of impact and make sure the other motorist pulls over as well.

Call the police immediately

** Do not let the other driver convince you to exchange information and leave the scene. No matter what they case, the driver at fault will almost always try and tell you they are running late, or need to be somewhere.. just to avoid any run ins with the police.  Do Not let them leave.. bottom line.

Exchange Information with the other Driver

Here are the specifics you will need to file an insurance claim:

  • Other driver – name, address, phone number, driver’s license number, and name of insurance company and policy number
  • Were there passengers?  Was anyone hurt?
  • Were there any Witnesses ?  If so, gather their info for later use.
  • Owner (if not the driver) – name, address, phone number, driver’s license number, and name of insurance company and policy number

Smart Drivers will Preserve Evidence and Take Notes on Scene

** Pictures of the damaged vehicles (both yours and the other vehicle)

** Pictures of the scene

** Any other pictures you feel will help

Recorded Statements by Insurance Companies

NEVER give a recorded statement to an insurance company other than your own. Doing so can destroy your right to pursue an action against the at-fault driver. Often, insurance companies will try to intimidate you or make false promises to pay in exchange for your cooperation and recorded statement.

What’s Next?

When the police arrive, file an accident report.

If you or your passenger were hurt, call your doctor or 911 immediately

If you were seriously injured…

Call Your Lawyer

If you have been involved in an accident, or if you have received a traffic ticket, your lawyer can advise you about your rights and responsibilities. The sooner you call your lawyer the better, since witnesses may forget the details of the accident. Your lawyer can counsel you on how to respond to questions from insurance adjusters and help you recover compensation for your personal injuries and damages to your car.
